We are seeing in history today a profound change in the way we interact with the people of world. We are giving rights to people who are not citizens of this country. From Illegal immigration to allowing the civilian courts to rule on cases they have no jurisdiction in the first place. With the recent US Supreme Court decision that gives rights to 600 or so, Detainees in Guantanamo Bay, we are now exploring unsure territory that has not been explore by any other country
Chief Justice John Roberts writes the rule of law and the American people have lost out-and with this ruling, we “lose a bit more control over the conduct of this Nation's foreign policy to unelected, politically unaccountable judges.”
Judges are now venturing into foreign Policy, an area they have not been in at all and is the privy of the President.
It also leaves the possibility of future detainees left to the mercies of our troops. Our soldiers are the most capable and the most reliable and effective tool we have to combat terrorism. The surge despite what some liberals say is working! But we have done so with smart intelligence. If this decision stands we are now leaving capture Terrorist to the soldiers. "Why should we capture terrorist to just let the courts release them to come back and kill us?" Other alternatives may become necessary to protect themselves and our country.
Can you imagine a solider reading the Miranda rights to a terrorist in the heat of battle?
It is regrettable that we have to decide midst if detainees deserved equal treatment under our constitution, when we see what they have do to people like Daniel Pearl and many others. But this has far reaching prospects than just a bunch of Detainees in Cuba.
If the courts can reach this far we can certainly see them reach further including voting rights, for people who are not citizens of this country or for that matter preventing further deportations of illegal aliens. Much to my dismay, it could also prove dangerous to the sovereignty of this country. It leads us to various other unrelated laws that could be examining in the same matter.
Justice Antonin Scala warns that the ruling “will almost certainly cause more Americans to be killed” and concludes, “The Nation will live to regret what the Court has done today. I believe he is right, But now the congress of the United States is left with the ultimate decision.
A number of laws need to be enacted, and amending the Geneva conventions to face the realities of this modern terrorist plague world. We may also need to decide if any illegal Alien or for that matter terrorist can appeal to our courts. Some may decry placing the two in the same category.
John McCain would be smart to bring this to the attention of the American people; he needs them to realize that this goes beyond being fair to Terrorist. It has everything to do with national sovereignty and the Rule of Law.
